1. Acceptance of These Terms

These Terms of Service govern your use of the Best Estie Day Spa website and any online inquiry, gift card, or membership checkout that begins on this website. By using the website or starting a purchase, you agree to these Terms. If you do not agree, do not use the website or submit information through it.

These Terms apply to the website. Your in-person spa service may also require separate intake, consent, safety, and treatment documents.

2. Our Business and Services

Best Estie Day Spa LLC operates a local day spa in Mesa, Arizona. We offer massage and esthetic services performed by appropriately licensed professionals. Appointments are subject to availability and are not confirmed by submitting an online request.

Our services and website content are for personal care, relaxation, and general wellness. They are not medical care, diagnosis, treatment, emergency services, or a substitute for advice from a physician or other qualified healthcare professional. Use of the website does not create a clinician-patient relationship.

If you believe you are experiencing a medical emergency, call 911. Ask a qualified healthcare professional whether a spa service is appropriate for you when you have a medical condition, are pregnant, take medication, or have other health concerns.

3. Website Information and Appointment Requests

We try to keep website descriptions, hours, prices, and availability accurate, but they may change. An appointment request is only a request. A member of our team must confirm the appointment with you.

Do not submit symptoms, diagnoses, prescriptions, insurance information, medical records, photographs of medical conditions, or other medical or highly sensitive information through the website contact form. Share information needed for service safety directly with the spa during booking or through the appropriate intake process.

4. Eligibility and Minors

You must be at least 18 years old, or the age of legal majority where you live, to make an online purchase or enter into a recurring membership. If you act for another person or a minor, you represent that you have authority to do so.

The website is not directed to children under 13, and children under 13 should not submit personal information through it. Rules for spa services provided to minors are stated in our Spa Policies and any service-specific consent materials.

5. Prices, Booking, and Payment

Prices are stated in U.S. dollars and may change before a purchase is completed. The price, renewal terms, and any applicable taxes or charges shown during booking or checkout control that transaction.

When you provide or authorize a payment method, you authorize the disclosed charges for the purchase, booking, or recurring membership. Payment, cancellation, no-show, voucher, credit, and refund rules are also described in our Spa Policies and in any terms shown when you book or check out.

6. Shopify Checkout

Online gift card and VIP membership purchases are completed through checkout pages hosted by Shopify. Shopify processes payment information and may apply its own terms and privacy practices. Best Estie Day Spa does not directly receive or store your full payment card number.

We receive order and customer information from Shopify that is needed to fulfill a gift card purchase, administer a membership, provide customer service, prevent fraud, and maintain required business records.

7. VIP Membership and Automatic Renewal

The VIP membership is a month-to-month recurring plan billed at $70 per month until canceled. By joining through Shopify checkout, you authorize Shopify and Best Estie Day Spa to charge the payment method selected at checkout for the disclosed recurring amount on each billing cycle.

• The first successfully paid membership order adds two service credits.
• Each successfully paid monthly renewal adds one service credit.
• One credit covers one eligible 50-minute spa service. A couples massage uses two credits.
• Unused credits roll over, and multiple accumulated credits may be used at one time.
• Your membership may be shared with a friend or family member.
• Membership is a credit program and does not create universal or repeat-use discounted pricing for additional services.

To cancel future renewals, call (480) 202-0720 during business hours, 9:00 AM to 8:00 PM, seven days a week, and request cancellation. Contact us before your next scheduled charge so we have time to process the request. A cancellation stops future renewals; charges that have already completed remain subject to the terms presented at purchase, our Spa Policies, and applicable law.

8. Gift Cards

Gift cards purchased online are processed through Shopify and may be used for eligible Best Estie Day Spa purchases, subject to the terms displayed at checkout and applicable law. Contact us before purchasing if you have questions about delivery, eligible uses, refunds, expiration, transfer, or a specific treatment.

9. Professional Conduct and Safety

Best Estie Day Spa provides professional spa services only. Inappropriate, threatening, abusive, discriminatory, sexually suggestive, or unlawful conduct is prohibited. We may end a service, refuse service, remove a person from the premises, or take other appropriate action when needed to protect guests, staff, or the business. Payment consequences are described in the Spa Policies.

10. Communications

When you submit an inquiry or purchase, you authorize us and our service providers to send transactional communications related to that request, order, appointment, or membership. Message and data rates may apply to communications sent by phone or text. Transactional consent is not consent to unrelated marketing.

11. Acceptable Use

You may not misuse the website, interfere with its operation, attempt unauthorized access, submit malicious code, scrape or copy content at scale, impersonate another person, commit fraud, violate another person’s rights, or use the website for an unlawful purpose.

12. Intellectual Property

The website, branding, photographs, text, graphics, and other content are owned by or licensed to Best Estie Day Spa LLC and are protected by applicable intellectual property laws. You may use the website for personal, noncommercial purposes. No other license is granted.

13. Third-Party Services and Links

The website may link to or use services operated by third parties, including Shopify, Google, social networks, mapping services, and review platforms. We do not control their services, availability, security, content, or privacy practices. Your use of a third-party service is governed by that provider’s terms.

14. Website Disclaimers

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” We do not promise that the website will always be available, error-free, secure, or complete. Results from massage, facials, skincare, and other personal care services vary by person, and no particular result is guaranteed.

15. Limitation of Liability

To the fullest extent permitted by law, Best Estie Day Spa LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or a third-party service. Nothing in these Terms limits liability that cannot legally be limited, including liability for gross negligence, willful misconduct, or rights that applicable consumer law does not allow you to waive.

Service-related rights, responsibilities, risks, and remedies may also be governed by separate intake or consent documents and applicable law.

16. Responsibility for Misuse

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the website, fraud, violation of these Terms, or infringement of another person’s rights.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to these Terms or the website will be brought in the state or federal courts located in Maricopa County, Arizona.

18. Changes, Severability, and No Waiver

We may update these Terms by posting a revised version and changing the “Last updated” date. Changes apply prospectively when posted unless a later date is stated. Material changes to a recurring purchase will be communicated as required by law.

If a provision is found unenforceable, the remaining provisions remain in effect. A delay in enforcing a provision is not a waiver of the right to enforce it later.
